Subject to the terms and conditions of this Agreement, HMIx.tech (owned and operated by Sergio Fernández Blanco, El Cañaveral, Madrid, Spain, 28052) grants you a non-exclusive, non-transferable, revocable, worldwide license to use, modify, and integrate the purchased or downloaded resources — including but not limited to Custom Web Controls (CWCs), Dynamic SVGs, faceplate templates, demo projects, and other digital assets — into your industrial Human-Machine Interface (HMI) and Supervisory Control and Data Acquisition (SCADA) projects.

This license is granted solely for the intended use of the resource within the scope of your automation, visualization, and control applications. The license becomes effective upon download or purchase and remains in effect until terminated in accordance with Section 10 of this Agreement.

Under this license, you are permitted to:

• Commercial Projects: Use the resources in commercial projects for your clients, your employer, or your own organization without additional royalty payments beyond the original purchase or download.
• Modifications: Modify the source code, design, structure, animations, and visual elements of the resources to fit the specific needs of your HMI or SCADA project, provided such modifications do not circumvent the restrictions set forth in Section 3.
• Multiple Projects: Use any single purchased or downloaded resource across multiple projects within the same organization. However, each individual user or developer seat within the organization requires a separate download or purchase unless otherwise stated in a specific product listing.
• Integration: Integrate resources into WinCC Unified, WinCC V8 (formerly WinCC Professional), Unified Comfort Panels, and other compatible SCADA/HMI runtime environments for which the resource was designed.
• Derivative Works: Create derivative works based on the resources, provided that such derivative works are substantially different from the original and are not distributed as standalone assets.

You expressly agree that you shall NOT:

• Redistribute, sub-license, rent, lease, or sell the resources (whether in original or modified form) as standalone assets, templates, libraries, or as part of any competing marketplace, asset store, or template repository.
• Claim exclusive ownership of the original vector graphics, scripts, animations, control logic, or visual components contained within the resources.
• Share, distribute, or make available your download credentials, license keys, or purchased resources to third parties not covered by your license.
• Use the resources in any application that competes directly with HMIx.tech or its services.
• Remove, alter, or obscure any copyright notices, watermarks, or proprietary markings from the resources.
• Use the resources in a manner that violates any applicable law, regulation, or industry standard.

The resources must be integrated into a larger project (e.g., an HMI application, a SCADA dashboard, or an automation system) to be distributed to third parties. Standalone redistribution is strictly prohibited.

Resources generated via the HMIx AI Generator (including Custom Web Controls and Dynamic SVGs for WinCC Unified and WinCC V8) are subject to special terms:

• License Holder: The user who triggers the AI generation is considered the primary license holder for the specific instance of the generated resource.
• Publication Consent: To download any AI-generated resource, the user must consent to the automatic publication of that resource on HMIx.tech, including a representative image and description. If consent is not granted, the finalized resource cannot be downloaded.
• Platform Rights: Upon publication, HMIx.tech retains a perpetual, irrevocable, worldwide, royalty-free license to host, display, distribute, and make the generated resource available to other users of the platform.
• No Exclusivity: AI-generated assets are not exclusive. Similar or identical outputs may be generated for other users who provide similar prompts or inputs. HMIx does not guarantee uniqueness of any AI-generated content.
• No Warranty on Output: HMIx makes no representations or warranties regarding the accuracy, completeness, fitness for purpose, or industrial safety compliance of any AI-generated content. Users are solely responsible for testing, validating, and certifying any AI-generated resource before deployment in production environments.

If you create a store on HMIx.tech and publish your own resources (whether free or paid), the following terms apply:

• Your Content: You retain full intellectual property ownership of the resources you create and publish. By listing them on HMIx.tech, you grant HMIx a non-exclusive, worldwide license to display, promote, and distribute your resources through the platform.
• Warranty of Originality: You represent and warrant that any resource you publish is your original creation or that you have obtained all necessary rights and permissions to distribute it. You shall not upload, publish, or distribute any resource that infringes upon the intellectual property rights of any third party.
• Revenue: Revenue from paid resources is subject to the commission structure disclosed on HMIx.tech. HMIx reserves the right to modify commission rates with reasonable prior notice.
• Content Moderation: HMIx reserves the right to review, reject, or remove any resource from the platform that violates these terms, infringes on third-party rights, or is deemed inappropriate, low quality, or harmful.

HMIx.tech offers both free and paid resources. The license terms set forth in this Agreement apply equally to both categories unless otherwise specified in a particular product listing. Free resources are provided under the same license restrictions as paid resources — the absence of a purchase price does not imply the absence of license restrictions. Free resources may not be re-sold, repackaged for sale, or used in a manner that violates the restrictions in Section 3.

All original resources available on HMIx.tech remain the intellectual property of their respective creators (including individual sellers who maintain their stores on the platform) or Sergio Fernández Blanco where applicable. This license does not transfer ownership, title, or any intellectual property rights from the creator or HMIx to you. HMIx retains all rights not expressly granted to you under this Agreement.

All trademarks, trade names, logos, and service marks displayed on HMIx.tech are the property of their respective owners. Siemens, WinCC, WinCC Unified, WinCC V8, SIMATIC, and related marks are trademarks of Siemens AG. HMIx.tech is an independent platform and is not affiliated with, endorsed by, or sponsored by Siemens AG.

Some resources available on HMIx.tech may incorporate or depend on third-party libraries, frameworks, fonts, icons, or other open-source or proprietary components. Such components are governed by their own respective licenses (e.g., MIT, Apache 2.0, GPL, or proprietary licenses). It is the user's responsibility to review and comply with all applicable third-party license terms. HMIx.tech does not assume liability for any third-party components included in the resources.

This license is effective until terminated. Your rights under this license will terminate automatically and without notice from HMIx if you fail to comply with any of its terms and conditions. Upon termination:

• You must immediately cease all use of the affected resources.
• You must destroy all copies, modifications, and derivative works of the resources in your possession or control.
• HMIx reserves the right to disable your account and revoke access to the platform.

Termination of this license does not affect the rights of other users who may have legitimately downloaded or purchased the same resources. Sections 7 (Ownership), 11 (No Warranty), 12 (Liability Limitation), and 13 (Indemnification) survive termination.

ALL RESOURCES AVAILABLE ON HMIX.TECH ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR SUITABILITY FOR ANY SPECIFIC INDUSTRIAL APPLICATION.

HMIx, its owner, developers, contributors, and marketplace sellers do not warrant that:

• The resources will meet your specific requirements or expectations.
• The resources will be error-free, uninterrupted, or free of harmful components.
• Any defects or errors in the resources will be corrected.
• The resources are suitable for safety-critical, life-critical, or mission-critical industrial applications without proper validation and testing by the end user.

YOU ASSUME ALL RISK REGARDING THE PERFORMANCE, SAFETY, AND SUITABILITY OF THE RESOURCES IN YOUR PRODUCTION ENVIRONMENTS. IT IS YOUR SOLE RESPONSIBILITY TO VALIDATE, TEST, AND CERTIFY ANY RESOURCE BEFORE DEPLOYING IT IN AN INDUSTRIAL OR PRODUCTION SETTING.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SERGIO FERNÁNDEZ BLANCO, HMIX.TECH, ITS AFFILIATES, PARTNERS, MARKETPLACE SELLERS, OR CONTRIBUTORS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING, BUT NOT LIMITED TO, LOSS OF PRODUCTION, LOSS OF DATA, LOSS OF PROFITS, BUSINESS INTERRUPTION, EQUIPMENT DAMAGE, PERSONAL INJURY, OR ANY OTHER PECUNIARY OR NON-PECUNIARY LOSS) ARISING OUT OF OR IN CONNECTION WITH THE USE OR INABILITY TO USE THE RESOURCES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

This limitation applies whether the damages arise from breach of contract, tort (including negligence), strict liability, or any other legal or equitable theory. Some jurisdictions do not allow the exclusion or limitation of liability for certain damages; in such cases, the liability shall be limited to the fullest extent permitted by law.

You agree to indemnify, defend, and hold harmless Sergio Fernández Blanco, HMIx.tech, and any associated parties from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with: (a) your use of any resource obtained from HMIx.tech; (b) your violation of any term of this Agreement; (c) your violation of any applicable law, regulation, or third-party right; or (d) any claim that a resource you published on HMIx.tech infringes the intellectual property rights of any third party.

HMIx reserves the right to modify, update, or replace this Licensing Agreement at any time. When material changes are made, the "Last updated" date at the top of this page will be revised. Continued use of the platform and its resources after any such changes constitutes your acceptance of the new terms. It is your responsibility to review this Agreement periodically. If you do not agree with the amended terms, you must cease using the platform and the resources immediately.

This Licensing Agreement shall be governed by and construed in accordance with the laws of the Kingdom of Spain, without regard to its conflicts of law provisions. To the extent applicable, the regulations of the European Union (including but not limited to the EU Digital Services Act, the EU Consumer Rights Directive, and the GDPR) shall also apply.

Any dispute, controversy, or claim arising out of or relating to this Agreement shall be submitted to the exclusive jurisdiction of the courts of Madrid, Spain. Before initiating any legal proceedings, the parties agree to attempt to resolve disputes amicably through direct negotiation or mediation.
